General data protection regulation (GDPR)

This regulation came into effect on 25th may 2018, affecting all business including Nails & Beauty by Charlotte Edwards.  It is in regards to any data a business may hold about a person.  When you contact Nails & Beauty by Charlotte Edwards via email link on this website or through phone or message via Facebook your information will be used in order for me to respond to your query.   In relation to Nails & Beauty by Charlotte Edwards, there are three types of data I may hold about you. Client data, technical data & photographs. Any personal data I hold about my clients (you) are held securely & are never shared with any third party under any circumstances.  This new legislation requires me to advise you of the privacy policy.

The personal information I hold regarding a client are as follows:

* Any medical history relating to treatments (contra indications)

This data is kept on a paper record card & stored securely in a locked filing cabinet, it is not shared with any third parties under any circumstances.  In addition to your client record card, I also hold personal information such as name & treatment in my appointment diary, along with your telephone number held on my phone, which is password protected. None of this information is shared with any third parties.  By law you are entitled to view this information at your request.

Technical Data

This is data held for clients who have treatments involving chemical services such as lash lift & tinting.  This information consists of the formula used on yourself in regards to the ratio of products used & development time in regards to the quality of your hair.

It will include medical history to determine wether you are suitable for the treatment, along with any patch tests & their results.  If you have any allergies these will also be listed on this record card.  There will be a record of each treatment you have had along with any comments in regard to said treatment.  This may include the condition of your nails or skin, or tension in relation to a massage etc.  You are entitled to view your record card at any time, in person.  I will not send a photo of this.  These records are kept securely in a locked filing cabinet.

Photographs

Images are never taken without verbal consent, if you are happy to knowingly pose for the pictures I post on my social media or website, that is your verbal consent.  If you would rather not have your picture taken that is your right & you would need to verbalise this at that point & of course your picture will not be taken. Once I have taken your picture with your consent, it will then be uploaded within a few days for the purpose of marketing.  It will only appear on my Facebook & Instagram business pages along with this website.  Other personal data is not required in these circumstances, no name will be attached to these images.

Why is this information held about me & how is it used?

Client data is held for reference & insurance purposes.  Your contact details including name, address, number & email are held so I can contact you in relation to your appointment, address so I can find your home when visiting for your treatment & email is held in order for me to send out any marketing vouchers/offers, business notices such as closures, working hours over holiday periods & price increases or any up coming events.  Your medical history is held in order for me to determine wether you are medically suitable for your treatment, so you would not suffer an adverse effect.  All the information you give in regards to your medical history is to safeguard you as the client.  It is important to give honest information in order for me to deliver your treatment safely. All patch tests will be noted on your record card detailing the result of test to ensure no reaction has occurred before the treatment can be carried out. The information held on these client records also safeguard myself from any potential insurance claim should you suffer any side effects from a treatment after not giving full & frank information.  Because of this these records have to be held for a minimum of 6 years for insurance purposes, if you decide to no longer use my services these client records still need to be held in my secure locked filing cabinet until those 6 years are over.  I will then dispose of the paper files through means of shredding.  Any contact information I have of you on my phone can be deleted at your request, at any time.

Will you ever sell my details to third parties?

Your personal details & information will never be shared or sold to any third parties under any circumstances.  Nails & Beauty by Charlotte Edwards is not affiliated or working for any third party organisation.  All marketing activities undertaken by Nails & Beauty by Charlotte Edwards are done via the following: my website, Facebook or Instagram.  None of which require the use of personal data or the sharing of your personal data.  Your information is not used for any activities other than what has been stated above.

How can my personal data be deleted?

In line with GDPR you have the right to refuse permission of any personal data to be held by me, if this is the case you need to notify me of this.  I will however be unable to continue any services without the above client records.  I of course can continue services if it is solely photographs that you wish to be deleted.  If you decide not to use my services after initial inquiry you can request for me to delete any data held of yours.

 

I haven't had any treatment done with you in over a year, do you still have my number?

If you have not used my services in over a year, I will delete your number & any images on my phone I have of you.  Your images will still appear on my website, Facebook & Instagram business pages.  I will therefore no longer have access to your contact number.

My website may contain links to other websites such as Facebook & instagram or other websites of interest, however please note I do not have any control over these websites.  once you have clicked these links & leave my site I cannot be held responsible for the protection & privacy of any information you provide whilst visiting these sites.  These sites are are not governed by this privacy policy.

Age

Nails & Beauty by Charlotte Edwards does not knowingly collect personal information from any person under the age of 16 years through this website.  Any person of any age can freely view & access any page of my website, Facebook or instagram business pages.  I do not check identities or moderate content.  It is you not I who provide access to my website for the children in your care.  It is for you to check the content your children view is suitable for them.  Where links are concerned, you may wish to check the privacy policies of those sites where your children may visit frequently to see how they collect & use information.  Filter software may also be useful to you.  you acknowledge we are not responsible for content that anyone may have placed on my website, Facebook or Instagram.  I am not responsible for the content of site accessible by a link from my website.  Any claim you may have on account of age related suitability & content you agree to waiver

What happens if I use your site to buy products?

When you create an account on this website to buy a product, voucher or service you are agreeing to my terms & conditions.  A contract is formed between yourself & I.  In order for me to carry out my obligations under that contract I must process the information you have given to me.  Some of this information may be personal, I use it in order to do the following

* Verify your identity for security purposes

* Sell products to you

* Provide you with my services

* Provide you with suggestions & advice on products, services & how to obtain the most from using my website.

I process this information on the basis there is a contract between us, or that you have requested I use the information before we enter into a legal contract.

Additionally I may aggregate this information in a general way & use it to provide information which helps me to monitor my performance with respect to a particular service I provide.  If I use it for this purpose, you as a person will not be personally identifiable.  I will continue to process this information until the contract between us ends or is terminated by either party under the terms of the contract.

Payment information is never taken by myself or transferred to me through my website.  At the point of payment you are transferred to a secure page on the website or another reputable payment service provider.  That page may be branded to look like a page on my website, but it is not controlled by me.

I  also record information about the software you are using to browse my website, such as the type of computer or device & the screen resolution.  I use this information in aggregate to assess the popularity of the webpages on my website & how to perform in providing you content.  If combined with other information I know about you from previous visits, the data could possibly be used to identify you personally even if you are not signed into my website.

Although I do not disclose your personal information to any third parties (except those as set out in this notice) I sometimes receive data that is indirectly made up from your personal information from third parties whose services I use, no such information is personally identifiable to you.  My website is built & hosted on the wix.com platform.  wix.com provides me with the online platform that allows me to sell my products & services to you.  your data may be stored through wix.com's data storage databases & the general wix.com applications.  they store your data on secure servers behind a firewall.

 

Your data may be maintained, processed & stored by wix & their authorised affiliates & service providers in the United States of America, in Europe (including Lithuania, Germany & Ukraine) in Isreal & in other jurisdictions as necessary for the proper delivery of their services &/or as may be required by law wix.com Ltd is based in Israel which is considered by the European Commission to be offering adequate level of protection for the personal information of eu member state residents.
